OFFICIAL RAFFLE RULES AND TERMS & CONDITIONS

 

These Official Raffle Rules (“Official Rules”) govern charitable drawings conducted by Project Pinball Charity Group, Inc. (“Project Pinball Charity”). By submitting an entry, each entrant agrees to be bound by these Official Rules. These drawings are intended to be conducted pursuant to Section 849.0935, Florida Statutes, and other applicable federal, state, and local laws. Any provision of these Official Rules that conflicts with mandatory applicable law will be interpreted or limited to the minimum extent necessary to comply with that law without invalidating the remaining provisions. Questions regarding a raffle or these Official Rules may be directed to Project Pinball Charity through the contact information listed below.

 

SPONSORING ORGANIZATION: Project Pinball Charity Group, Inc. is a nonprofit charitable organization recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code. The raffle is conducted by: Project Pinball Charity Group, Inc., P.O. Box 368022, Bonita Springs, Florida 34136

 

PURPOSE: Project Pinball Charity conducts charitable raffles to support its charitable mission and programs. Participation in a raffle is voluntary.

 

RAFFLE PERIOD: The date and time of each drawing will be in the applicable raffle announcements as required by Florida law. The drawing will be conducted on the announced date in accordance with these Official Rules and applicable laws.

 

DRAWING DATES: The drawing will be conducted on the announced date in accordance with these Official Rules and applicable law, after all entries are accounted for.

 

RAFFLE DRAWING INFORMATION: All raffle drawing information to be posted to the specific Rally-Up raffle page.

 

ELIGIBILITY: To enter, you must be: (1) Eighteen (18) years of age or older; (2) Be legally eligible to participate under the laws applicable to the entrant. (3) Provide accurate information sufficient to identify and contact the entrant. (4) All Entrants must comply with these Official Rules. (5) Can’t be an employee, officer, director or agent of the Project Pinball Charity, or any of their respective affiliates, subsidiaries or promotion agencies (collectively Sponsor and its affiliates and related individuals); and (6) Can’t be an immediate family member or living in the same household of any individual identified in (5) above. All federal, state and local laws and regulations apply. The raffle is VOID where prohibited or restricted by law or regulations. It is the entrant’s responsibility to determine whether participation is lawful in the entrant’s jurisdiction.

 

HOW TO ENTER: The Project Pinball Machine Raffle is a randomized drawing. To constitute a complete entry, you must provide your full legal name, complete and valid mailing address; valid email address, and valid telephone number and donation payment or AMOE request received. An entry cannot be completed unless this information is given for this purpose. Incomplete entries are void. P.O. Boxes Addresses will not be permitted as shipping address. For a valid donation entry: after entering correct information in all the fields online and clicking on the submit button, you will immediately be entered in a database for a random drawing to win the prize offered in the raffle. One entry equals one entry. An Alternative Method of Entry (“AMOE”) may be requested only by mail. All AMOE requests must be mailed to: Project Pinball Charity Group, Inc., P.O. Box 368022, Bonita Springs, Florida 34136. To be considered valid, an AMOE request must be mailed to and received at the address listed above in accordance with all requirements and deadlines set forth in these Official Rules. AMOE requests mailed, delivered, submitted, or sent to any other address, location, email address, website, social media account, or by any other method will not be accepted and will be deemed invalid. No AMOE requests will be received at Project Pinball Charity’s physical address. To request an AMOE, an applicant must submit a written request CLEARLY stating the applicant’s intent to receive an AMOE request. The written request must include the applicant’s: full legal name, complete and valid mailing address; valid email address, and valid telephone number. All information submitted in connection with an AMOE request is subject to review and verification by Project Pinball Charity. An AMOE request will not be issued unless all required information has been received and determined to be complete and valid. Any AMOE request that is incomplete, illegible, inaccurate, contains false or misleading information, fails to comply with these Official Rules, or cannot reasonably be verified may be rejected and deemed null and void. Upon successful verification and approval, an eligible applicant will receive one AMOE request into the raffle drawing that is active at the time the AMOE request is approved, subject to the applicable entry limits and all other provisions of these Official Rules. Submission of an AMOE request does not guarantee an entry. No AMOE request is valid unless and until the request has been reviewed, verified, and approved by Project Pinball Charity Group, Inc. One AMOE entry equals one entry. A donation does not increase an entrant’s odds of winning. An individual may not obtain additional entries by using multiple names, aliases, mailing addresses, email addresses, accounts, payment methods, fictitious identities, or other means intended to circumvent the entry limitation. Submitting an entry through another person for the purpose of circumventing the entry limitation is prohibited. If multiple submissions are determined to have been made by or on behalf of the same individual, only the number of entries permitted under these Official Rules will be eligible for the drawing. Any deliberate attempt to damage a raffle, raffle website, interfere with the entry process, manipulate the drawing, obtain unauthorized entries, compromise raffle data, or otherwise undermine the legitimate operation of a raffle is prohibited.

 

Project Pinball Charity reserves the right to pursue appropriate remedies permitted by law against individuals engaging in fraudulent, malicious, or unlawful conduct.

 

The potential winning entry must provide the Project Pinball Charity with proof that the potential winner is the person named for the winning entry. All potential winners are subject to verification before any prize is awarded. False or deceptive entries or acts will render the entrant ineligible. False entries become the official property of the Project Pinball Charity and will not be acknowledged or returned. Project Pinball Charity and its affiliates and related individuals will not accept correspondence or telephone inquiries regarding the false status of entries or the administration of the raffle. By entering this raffle, each participant agrees to be bound by these official rules and by all decisions of Project Pinball Charity, whose decisions regarding all aspects of the raffle shall be final.

 

ENTRY VERIFICATION AND DUPLICATE ENTRIES: Project Pinball Charity may take reasonable steps to verify: Identity, Age, Contact information, Eligibility, Compliance with the entry limit, and Compliance with these Official Rules. Project Pinball Charity may request reasonable documentation when necessary to verify eligibility or identity. Verification will not be conditioned upon receiving a donation. Any entry containing materially false, fraudulent, deceptive, or intentionally misleading information may be disqualified. Project Pinball Charity will not arbitrarily reject an otherwise eligible entry and will not discriminate between an entrant who makes a voluntary contribution and an entrant who does not.

 

PROHIBITED ENTRY PRACTICES: Entrants may not attempt to manipulate, circumvent, interfere with, or abuse the raffle entry process. Prohibited conduct includes, but is not limited to: using fictitious identities, submitting materially false information, creating multiple identities or accounts for the same individual, using aliases to circumvent the entry limit, using automated entry systems, bots, scripts, macros, or similar technology, submitting entries on behalf of another person for the purpose of circumventing the entry limit, tampering with the raffle website or entry platform, or attempting to interfere with the fairness or integrity of the drawing. Project Pinball Charity may disqualify an entry when it reasonably determines, based on documented facts, that the entry violates these Official Rules.

 

SELECTION OF WINNERS: One winner for each of the prizes will be selected from among all entrants in a random drawing to be held on dates as listed. The winners will be notified by email. To claim the prize, each winner must: (1) Respond as directed within ten days of the first notification attempt; and (2) return to Project Pinball Charity, by the date and in the manner Project Pinball Charity directs in writing. If the winner cannot be reached or fails to timely respond or comply with any of these requirements or if Project Pinball Charity determines the winner ineligible or disqualified, then, in Project Pinball Charity’s sole discretion, the winner may be disqualified and the prize forfeited. In such event, an alternate winner will be selected by random drawing from remaining eligible entries. By accepting a prize, the winner grants permission for Project Pinball Charity’s use of the name, hometown, likeness, photograph, voice and statements of winner and winner’s travel companion(s) for advertising/publicity purposes without further compensation or permission, unless prohibited by law.

 

ODDS OF WINNING: Project Pinball Charity will conduct a drawing through which one winner will be randomly selected from among all eligible entries received in accordance with these rules. Odds of winning are based on the number of qualified entries submitted for each raffle which is recorded to be two hundred.

 

WINNER’S LIST: The winner’s list will be updated after each drawing date. A winner’s list will be post at https://projectpinball.org/pinballmachineraffles/.

 

PRIZES: The winning prize is: (1) A brand new pinball machine specific to the specific raffle. (2) A $500 shipping allowance will be included as part of the prize. Any shipping cost above the $500.00 amount will be the responsibility of the winner. Delivery may be made to the nearest appropriate freight terminal or by another freight-delivery method selected by Project Pinball Charity. Any additional services requested by the winner, including special delivery, inside delivery, lift-gate service, storage resulting from delayed acceptance, re-delivery, or other extraordinary shipping requirements, may be the responsibility of the winner.

 

Project Pinball Charity will arrange shipping to an address supplied by the winner. The winner is responsible for providing accurate delivery information and reasonably cooperating in arranging delivery. If the winner cannot take the prize during scheduled dates specified by the Project Pinball Charity and if additional costs are added by the delay because of this failure, they will be the responsibility of the winner. Project Pinball Charity shall have no further obligation to the prize winner for warranty of product or other similar guarantees. Prize is NON-TRANSFERABLE AND MAY NOT BE SOLD; no substitutions or cash awards will be allowed. Any taxes, customs regulations, security mandates, and/ or duties/fee on prizes are the sole responsibility of the prize winner. All details of any prize not specified herein shall be determined solely by Project Pinball Charity.

 

PRIZE ACCEPTANCE AND PUBLICITY: Except where prohibited by law, acceptance of a prize constitutes permission for Project Pinball Charity to identify the winner by name and general place of residence and to use photographs, video, statements, or other publicity voluntarily provided or created in connection with presentation of the prize for legitimate charitable, promotional, and publicity purposes without additional compensation. Any publicity use remains subject to applicable law.

 

USE OF INFORMATION: By entering the raffle, you agree that your entry and any other personally identifiable information collected or used in connection with the raffle may be used by the Project Pinball Charity in accordance with the privacy policy. The prize winner’s name and state of residence will be posted on the website. Entries will be shared with raffle sponsors only for marketing purposes.

 

WINNER ANNOUNCEMENT: The winner may be announced on the Project Pinball Charity website, applicable raffle platform, social media channels, or other Charity communications following verification. Winner information will be limited as reasonably appropriate and as required or permitted by applicable law.

 

WEBSITE AND TECHNOLOGY: Project Pinball Charity uses reasonable measures to maintain the availability and security of its website and third-party raffle platforms but cannot guarantee uninterrupted or error-free operation. Project Pinball Charity is not responsible for temporary website outages, telecommunications failures, internet interruptions, server failures, corrupted transmissions, or other technical problems outside its reasonable control. An online submission is not considered successfully received until the raffle platform or Project Pinball Charity records the submission.

 

Technical difficulties will not be used to discriminate between donating and AMOE entrants. If an entrant experiences a technical problem, the entrant should contact Project Pinball Charity as soon as problem is known.

 

FAIRNESS AND INTEGRITY OF DRAWING: Project Pinball Charity reserves the right to protect the integrity and lawful administration of its raffles. Nothing in these Official Rules authorizes Project Pinball Charity to arbitrarily reject an eligible entry, discriminate against an entrant because the entrant did not make a contribution, condition a drawing upon fundraising results, or otherwise take an action prohibited by applicable Florida law. Any decision concerning eligibility or rule enforcement will be based upon these Official Rules and the facts reasonably available to Project Pinball Charity.

 

RELEASE AND LIMITATION OF LIABILITY: To the fullest extent permitted by applicable law, by participating in the raffle, entrants agree to release and hold harmless Project Pinball Charity and its officers, directors, employees, volunteers, agents, service providers, and affiliates from claims, losses, damages, liabilities, or expenses arising from participation in the raffle or acceptance, possession, use, or misuse of a prize, except to the extent such release is prohibited by law. This release applies only to the extent permitted by applicable law and does not limit any rights that cannot legally be waived.

 

CHANGES NECESSARY FOR LEGAL COMPLIANCE: Project Pinball Charity may make modifications reasonably necessary to comply with applicable law, a governmental order, or a binding regulatory requirement, provided that no modification will be used to discriminate between donating and AMOE entrants or to improperly deny an eligible entrant a fair opportunity to participate. Project Pinball Charity will not cancel a drawing in violation of Florida law.

 

TAXES AND TAX REPORTING: The winner is solely responsible for all federal, state, local, and other taxes, fees, assessments, or other obligations arising from the acceptance, ownership, or receipt of the prize. The winner is responsible for providing Project Pinball Charity with complete, accurate, and truthful information required for all applicable tax reporting, including the winner’s correct legal name, address, social security number or taxpayer identification number, and any other information required to complete IRS Form 5754, W-2G, W-9, Form 1099, or any other federal, state, or local tax document or reporting requirement. Project Pinball Charity will prepare, and file tax forms required by law based upon the information provided by the winner. The winner is solely responsible for the accuracy and completeness of the information provided by Project Pinball Charity for tax-reporting purposes. Project Pinball Charity shall not be responsible for penalties, interest, additional taxes, expenses, losses, or other consequences resulting from inaccurate, incomplete, false, or outdated information supplied by the winner. The winner agrees to promptly complete and return any reasonably required tax forms or documentation requested by Project Pinball Charity. Failure or refusal to provide information or documentation required by law may delay delivery or transfer of the prize and may result in other consequences as required by applicable law. The winner is encouraged to consult their own qualified tax professional regarding the federal, state, and local tax consequences of accepting the prize. Project Pinball Charity will not be responsible for providing tax advice to the winner.

 

CONDITIONS OF PARTICIPATION: BY PARTICIPATING IN THIS RAFFLE, EACH PARTICIPANT RELEASES AND HOLDS HARMLESS PROJECT PINBALL CHARITY AND ITS AFFILIATES AND RELATED INDIVIDUALS FROM ANY AND ALL LIABILITIES, DAMAGES, LOSSES, EXPENSES, INJURIES, CLAIMS AND ACTIONS OF ANY KIND ARISING OUT OF OR RESULTING FROM PARTICIPATION IN THIS RAFFLE OR FROM ACCEPTANCE, USE OR MISUSE OF ANY PRIZE, INCLUDING WITHOUT LIMITATION, CLAIMS BASED ON DEATH, PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY. By participating in this raffle, each participant further agrees that any and all disputes, claims, and causes of action arising out of or in connection with this raffle, or any prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a state court within the state of Florida. All issues and questions concerning the construction, validity, interpretation and enforceable of these official rules, or the rights and obligations of entrant and Project Pinball Charity in connection with the raffle, shall be governed by, and construed in accordance with the laws of the state of Florida, without giving effect to any choice of law or conflict of law rules or provisions (whether the state of Florida or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the state of Florida. Project Pinball Charity reserves the right at its sole discretion to disqualify any individual found to be tampering with the entry process or the operation of this raffle or any website related to this raffle, acting in violation of these official rules or acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed or the like entry methods will void all such entries by such methods, and disqualify any entrant using any such method. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE RELATED TO THIS RAFFLE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS RAFFLE MAY BE VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE; PROJECT PINBALL CHARITY RESERVES THE RIGHT TO SEEK DAMAGES FROM SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. Project Pinball Charity is not responsible for any incorrect or inaccurate information, whether caused by users of any website related to this raffle, by any of the equipment or programming associated with or utilized in this raffle or by any technical or human error which may occur in the processing of submissions in this raffle. Project Pinball Charity assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of, any website related to this raffle or any technical failure or malfunction.

 

Project Pinball Charity is not responsible for any injury or damage to entrants’ or to any other person’s computer related to or resulting from participating in this raffle or use of any website related to this raffle. If, for any reason, this raffle is not capable of running as planned, including, without limitation, by reason of, infection by computer virus, bugs, worms, tampering, hacking, unauthorized intervention, fraud, technical failures, or any other causes which, in Project Pinball Charity’s sole judgment, corrupts or affects the administration, security, fairness, integrity or proper conduct of this raffle, Project Pinball Charity reserves the right at its sole discretion to cancel, terminate, modify or suspend this raffle, and select winners from entries received prior to action taken, as Project Pinball Charity, in its sole judgment, deems fair and in accordance with these official rules without notice to entrants. In the event that this raffle is challenged by any legal or regulatory authority, Project Pinball Charity reserves the right to discontinue or modify this raffle, or to disqualify participants residing in any affected geographic area. In such event, Project Pinball Charity shall not have any liability to any participants who are disqualified as a result of such an action. IN NO EVENT WILL PROJECT PINBALL CHARITY AND ITS AFFILIATES AND RELATED INDIVIDUALS (EITHER JOINTLY OR INDIVIDUALLY) BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF PARTICIPATION IN THIS RAFFLE, ANY PRIZES WON, ACCESS TO AND USE OF THE PROJECT PINBALL CHARITY’S WEBSITES OR THE DOWNLOADING OR COPYING FROM AND/OR PRINTING OF ANY MATERIAL OBTAINED FROM SUCH WEBSITES. I have been engrossed in the pinball community for 7 years now and I can say without a doubt it has changed me forever. Growing up in Springfield, OH I never really ran into any pinball machines out in the wild before. It wasn’t until I moved to Florida and was going to college that I ever played a real pinball machine. After my first game on Theatre of Magic, I was hooked, to say the least.

 

After volunteering for Project Pinball, I was quickly hired onto the Team. At first, I was the Media Relations Specialist, then the Media Director, and now I oversee the whole operation as the Director of Operations. I am blessed to have such a rewarding career. To see the children and their families receive the gift of Pinball and be able to utilize the machines for their therapeutic benefit is huge for recovery and rehabilitation. Not to mention, the amount of stress relief that pinball provides is truly incredible.

 

After assisting in over 50 pinball machine dedications, I can say how inspiring these children and their families are. Pinball is truly therapeutic and empowering for each individual who comes in contact with it.

 

My favorite pinball machines are Circus Voltaire, Godzilla, and The Addams Family, because you can’t have just one favorite.

Hi there! My name is Taj Kniceley (she/her/hers) and I am the Marketing and communications Specialist/Grant Writer for Project Pinball Charity. I grew up in Springfield, OH, and I now live in Western Michigan on a soon-to-be farm with my partner Tyler! My biggest (unkept) secret is that I am absolutely in love with my two cats Laela and Rosie.

 

In 2021, I joined the Team when I heard they were searching for a writer. Language is incredibly powerful and I knew I could help elevate the mission by providing a new perspective. What I love most about my role is that I not only have the opportunity to serve patients and families but that I am also able to deepen community relations. Project Pinball Charity is truly a grassroots charity, and strengthening connections is necessary when it comes to a community’s health and longevity.

 

My favorite pinball machine, as well as Broadway show, is The Phantom of the Opera. A close second is The Addams Family, although my favorite Morticia Addams is Carolyn Jones - the OG. If Pennywise ever makes it onto a pinball machine, though, then it’s game over for the other two!

As far as I can remember, I’ve been a pinball machine enthusiast. Growing up in the 1970’s & 1980’s, pinball machines were everywhere. I bought my first pinball machine at age 12 with paper route money and the neighborhood kids lined up to play. Today I’m living my childhood dream - fortunate enough to own a collection of 25 machines; most of them from the 70’s & 80’s.

 

I host Orange County NY Pinball Club events and host my own tournaments called The Catskill Classic. I enjoy competing in pinball tournaments, always meeting interesting people, and making new friends. Some of my best friends I’ve met through pinball.

 

I met Daniel Spolar at The Southern Pinball Festival near Orlando Florida in 2011. At the time, Daniel was seeking support from the local pinball community, in raising funds and technical assistance to rehabilitate a pinball machine that was donated to a Children’s Hospital for the kids to enjoy, but it wasn’t being maintained - thus defeating its intended purpose. Daniel was so passionate about the need to fix this pinball machine for the kids and keep it regularly maintained, that it was an extremely easy cause for me to support. I was impressed by Daniel’s desire to involve the pinball community, rather than fixing the problem on his own. As time went by, I became very good friends with Daniel, and as Project Pinball Charity has grown, I’ve continued my support by helping to spread awareness about its mission.

 

I’ve organized and promoted fundraising events, worked the booth at pinball conventions, attended several pinball machine dedications at Children’s Hospitals and Ronald McDonald Houses, prepared donated machines for fundraising, and I’ve talked about Project Pinball Charity in the local media. It’s a wonderful cause that provides so many benefits to countless individuals and families, it’s been easy for me to encourage others to help support our mission. I’m always thankful and humbled by the generous support we receive. I hope to continue my association with Project Pinball Charity for many years to come!!

 

My favorite pinball machines are Gottlieb 300, Stern Stars, The Addams Family, and Iron Maiden.

It was more than 20 years ago when I picked up three System 11 machines and 'found' the pinball community. The friendships that I've developed are invaluable. I learned fairly early on that the hobby is as much about the people as the machines, if not more so.

 

It was in 2019 that I had a 5-hour breakfast with Daniel. It was during that time I realized I wanted to do what I could to help Project Pinball. I had the idea of a silent auction at Pinball Expo and worked to organize it. The feedback was great and we've had one each year since. I was invited to attend a local dedication and it was transformative. As soon as the machine was ready, children immediately came to check it out. One child played with his rolling IV stand at his side which was incredible to witness. I was asked if I'd be interested in helping the charity as the Technician Coordinator.

 

I came to Project Pinball to do something that would have a positive and tangible impact on the lives of others. I would like to assist in the expansion of the charity and branding while working to do whatever is necessary to support operations. I would love to see 100+ machines placed all over the world! I know we have supporters in the UK who would be happy to be Volunteer Technicians supporting machines, let's see if we can make it happen. It can't be put into words the impact the machines have on the children and their families. I am excited to have the charity continue to have a positive and lasting impact on so many lives.

 

My favorite pinball machine is Transporter the Rescue.

Daniel Spolar originally from Pittsburgh, once lived in Bonita Springs, and now resides in Fort Myers with his adorable miniature pinscher, Maggie.

 

He is a pinball enthusiast with a collection of well over 30 pinball machines, as well as an avid road cyclist.

 

He enjoys traveling the country and placing pinball machines for the pure joy that they bring to others around him.

 

He is usually outdoors doing all kinds of adventurous activities, including hang gliding.

 

He will never back down from a challenge and is always working to better others' lives. Daniel does not have a favorite pinball machine because there are too many to choose from!
